1. Nature of the Service
Track My Tax SA is a digital expense tracking, income recording, and provisional tax estimation tool. It does not constitute tax advice, legal advice, accounting services, or a tax return preparation service. Nothing on this platform is a professional opinion on your tax obligations.
2. No professional relationship
Use of this Service does not create a professional relationship between you and Track My Tax SA (Pty) Ltd, its directors, employees, or AI systems. AI-powered categorisation, VAT assessments, and tax estimates are generated by automated systems and have not been reviewed by a qualified tax practitioner or SARS official.
3. Your responsibility to verify
You are solely responsible for verifying the accuracy of all information captured, categorised, or calculated by the Service. Specifically:
- AI categorisation of expenses, income types, and VAT may be incorrect or incomplete.
- Tax estimates are indicative only and based solely on data you have entered.
- Tax legislation changes frequently — calculations may not reflect the most recent amendments.
- You must review every categorisation before relying on it for any submission to SARS.
4. Obligation to consult a professional
Before submitting any tax return, VAT201, IRP6, or any return to SARS, you must consult a registered tax practitioner, chartered accountant, or other qualified professional registered with SAIPA, SAICA, SAIT, or CIMA. The existence of a summary on this platform does not mean it is ready for submission to SARS.
5. Limitation of liability
To the maximum extent permitted by South African law, Track My Tax SA (Pty) Ltd shall not be liable for:
- Any SARS penalties, interest, or additional tax assessments
- Incorrect expense categorisation or VAT assessments
- Failure to claim a deduction or exemption you were entitled to
- Any audit, query, or enforcement action by SARS
- Financial loss resulting from reliance on the Service
- Data loss, technical errors, or service interruptions
The Service is provided "as is" without warranties of any kind. Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.
6. VAT Act compliance
VAT assessments are indicative only and do not constitute a SARS ruling. A valid tax invoice per section 20 of the Value-Added Tax Act No. 89 of 1991 must be held before any input VAT deduction can be claimed. The Service cannot verify whether a document constitutes a compliant tax invoice. Apportionment of input VAT between taxable and exempt supplies remains the user's responsibility.
7. Beta disclaimer
Track My Tax SA is currently in beta. The Service may contain bugs, errors, or incomplete features. Tax calculations, categorisations, and VAT assessments may be inaccurate. We reserve the right to modify, suspend, or discontinue any feature without notice during the beta period. By using the Service you acknowledge and accept these limitations.
8. Force majeure
Track My Tax SA shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: power outages (including load shedding), internet infrastructure failures, acts of God, third-party API outages (including OpenAI, Supabase, or Netlify service interruptions), cyberattacks, changes in legislation, or government actions. In such events we will endeavour to restore the Service as soon as reasonably practicable.
9. Privacy and POPIA compliance
Track My Tax SA (Pty) Ltd processes your personal information in accordance with the Protection of Personal Information Act No. 4 of 2013 (POPIA). By creating an account you consent to the processing of your personal and financial information for the following purposes:
- Providing the expense tracking and tax estimation Service
- AI-powered document scanning and categorisation (via OpenAI APIs)
- Subscription management and billing via PayFast
- Communication regarding your account and the Service
Your rights under POPIA include the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your account and associated data
- Object to the processing of your information
- Lodge a complaint with the Information Regulator of South Africa
We do not sell your personal or financial data to third parties. Documents uploaded for scanning are processed temporarily via third-party AI APIs and are not retained beyond the scope of the API call. Our appointed Information Officer can be contacted at [email protected].
10. Acceptable use
You may not use the Service to facilitate tax evasion, money laundering, fraudulent SARS submissions, or any activity that contravenes South African law. Any such use will result in immediate account termination and may be reported to the relevant authorities.
11. Subscription and payment
Paid subscriptions are billed monthly or annually. Payments are processed via PayFast. Fees are non-refundable except where required by the Consumer Protection Act No. 68 of 2008. We reserve the right to change pricing with 30 days' written notice.
12. Amendments
We reserve the right to amend these Terms at any time. Continued use of the Service after notification of amendments constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
